Did You Know?
There is a lot of confusing, misinformation regarding timeshare contracts and compensation which makes it difficult for owners to find out what is relevant to them and what they can do about it. Here’s a few things you need to know about timeshares.
- Timeshare contracts can be very complicated and take time to get out of, but with the right legal guidance the situation isn’t as hopeless as the timeshare companies would want you to believe.
- Timeshare companies make their money by charging people annual maintenance fees that increase continually over time, knowing the occupants are locked into a contract. With threats of debtors against them, people continue to pay for years even when they don’t want to or no longer use the timeshare.
- If you believe you were mis sold your timeshare then you could have a good case for getting out of your timeshare contract.
- Depending on the circumstances and type of contract, you could even be entitled to compensation for your mis-sold timeshare contract.
Could You Be Entitled To Timeshare Compensation?
If you are unhappy or have any concerns about the way in which your timeshare was sold to you then it could be well worth seeking legal advice from a professional timeshare solicitor.
If you experienced any of the problems below then you could have a case for a timeshare compensation claim.
• The Hard Sell
Unfortunately, it has become extremely common for those who buy a timeshare to fall victim to the ‘hard sell’ tactics of the salesmen. Often prospective buyers are lured to ‘presentations’ over meals or cocktails or with the promise of free spa sessions or golf days only to be met with intense, high pressure sales tactics. These are often rushed which means that the buyers are unable to thoroughly read the contract, assess the pros and cons of timeshare ownership and come to a careful, informed decision.
• Lies, Misleading and Empty Promises
Along with the hard sell usually comes the misleading or fake information and lots of false promises. Potential buyers are often told that their timeshare will be a great investment, will hold or even increase in value and will be easy to sell when they want to and so on. Unfortunately, none of this is true and timeshares are in fact notoriously difficult to sell, do not hold their value and the large majority of owners make a huge loss on their ‘investment’.
• Questionable Contracts
Another issue that buyers face with their timeshares is the contract themselves which are usually long, complicated and comprise of clauses and legal terminology that most people do not fully understand. They use this as a way to add in things such as the ‘in perpetuity’ clause which ties the buyer in for life or for at least 50 years. Other terms they also include are things such as floating weeks, hidden charges and the dreaded maintenance fees, which are subject to annual increases that can grow exponentially over time. Often hidden within the small print these can end up costing the buyers a lot more then they realised or can reasonably afford.
