Have you purchased from Azure Resorts? If so, you are entitled to a full refund, even if they have previously denied a claim.
In a major victory for consumers, Sarah Waddington Solicitors have received communication from Barclays Partner Finance (BPF) agreeing to refund all payments made by consumers in respect of their timeshare purchases from Azure Resort Limited (ARL) providing they meet the required criteria.
The decision means that if you meet the required conditions and made a purchase through Azure Resorts Limited, you are due a full refund. Those that believe they may be eligible for this refund or wish to know more can contact us for clarification.
Have Barclays Partner Finance (BPF) broken the regulations?
Acting on behalf of our Azure clients, we have been corresponding with BPF and the Financial Conduct Authority about the legalities of financial arrangements offered by BPF to assist customers looking to purchase from Azure Resorts. Although BPF have previously rejected some of our claims, BPF have now promised to refund all payments to Azure consumers.
What has happened?
The case is extremely complex and has taken several months. Our view was the role of credit intermediary had not been satisfactorily discharged in line with the regulations. We supported our case with substantial evidence and took advice from expert counsel.
Despite previously rejecting claims, BPF have now released this statement:
“Following a thorough and detailed review of complaints related to the Azure timeshare book, various factors have come to light that indicate Azure did not consistently adhere to the standards we expect of our credit brokers when providing credit to BPF/CFSL customers.’
As an Azure timeshare owner, how can I receive a full refund?
This admission means that anyone who made a purchase with Azure and meets the required criteria is entitled to a refund.
How do I know if I am a victim of an Azure mis-sold timeshare?
BPF’s admission means that some Azure owners who purchased a product through Azure is entitled to a refund. It doesn’t matter if you have previously had a claim rejected, been told that you have run out of time, or instructed another party to make a claim.

What about the timeshare contract, will I be relinquished?
No decisions have been reached at this stage regarding the timeshare ownership status, but we remain in contact with BPF. At this stage, the timeshare will be unaffected, but that may change in the future and we would advise owners to take independent legal advice on any worries and concerns they might have about this issue moving forward.
