The main concern spread by the holiday companies is that they have had a 500% increase in holiday sickness claims since 2013 – a rise not seen in other countries. This together with the fact that legal costs are not currently capped on these types of claims make it a major concern for the government and big holiday companies.
What I would say is, if you have a genuine claim and you can provide evidence to support your case (such as medical diagnosis, photos of poor hygiene standards, raw food and other reports of poor practices within the hotel) then you should not be put off claiming as you will be able to sue for damages.
