Azure Timeshare owners will receive a full refund

Sarah Waddington Solicitors are delighted to announce, after much legal wrangling, that we have now succeeded in obtaining confirmation from Barclays Partner Finance (“BPF”) that they will refund all payments made by our clients in respect of their Timeshare purchases from Azure Resorts Limited (“ARL”).

For several months, we have been in correspondence with Barclays Partner Finance (BPF) and the Financial Conduct Authority (FCA) with regards to the legalities of the finance agreements provided by Barclays Partner Finance (BPF) to assist consumers in purchasing Timeshare products from Azure Resorts (ARL). Despite initially having our arguments rejected over that time, confirmation has now been received that Barclays Partner Finance (BPF) will refund all payments for Timeshare purchases made by our clients to Barclays Partner Finance (BPF).

Did Barclays Partner Finance (BPF) break the regulations?

Sarah Waddington was of the view that the role of the credit intermediary was not performed in line with regulations.

“We collated a significant amount of evidence to support our position and took expert advice from Counsel. Despite the complex arguments put forward by us, they were rebuffed by Barclays Partner Finance (BPF).”

Nevertheless, Barclays Partner Finance (BPF) have now accepted that Sarah Waddington’s legal argument was correct, and confirmation was recieved from Barclays Partner Finance (BPF) that they will “refund all payments and fees to customers “ Who put the right legal argument to them in their claim.

BPF went on to state as follows: –

Following a thorough and detailed review of complaints related to the Azure timeshare book, various factors have come to light that indicate Azure did not consistently adhere to the standards we expect of our credit brokers when providing credit to BPF/CFSL customers.”

What next for Azure Owners?

This, though, is not the end of the matter. All consumers who purchased from Azure Resorts (ARL) using finance will not necessarily receive the compensation that our clients will. There is no guarantee that those individuals, who are not our clients, will receive any money whatsoever. As above, the arguments in relation to this issue are complex and have been developed by this firm over many months.
